Terms of Agreement:
All accounts on our web servers are subject to the terms and conditions set forth in this document. This includes all listings with or without demo reels, and any other piece of information placed on our network. Placing data on our network is an acknowledgement that you have read, understand, and agree to be bound by the terms and conditions below.
Cancellation of Accounts:
To cancel an account, please contact our Customer Service Department at info@city-demos.com. You may cancel your account at anytime. City-Demos must receive notification of cancellation at least seven business days prior to your next billing date, which would be the next billing cycle. If outstanding amounts are due to City-Demos, cancelling an account will not remove these obligations of payment.
Refusal or Discontinuation of Service:
City-Demos reserves the right to refuse or discontinue service to anyone at City-Demos' sole discretion. City-Demos shall have no responsibility to notify any third-party providers of services, merchandise, or information, nor any responsibility for any consequences resulting from such discontinuance or lack of notification. You agree that City-Demos has the right to monitor the service electronically from time to time and to disclose any information as necessary to satisfy the law, or to protect itself or its subscribers. City-Demos reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this agreement. City-Demos also reserves the right to refuse refunds in cases where City-Demos believes abuse has taken place.
Indemnification Policy:
You agree to supply appropriate payment for the services received from City-Demos, at the time of service purchase. This policy does not apply to any additional services such as overages, maintenance fees, etc. Accounts cancelled/terminated by City-Demos for violating our Acceptable Usage Policy do not qualify for a refund. Sharing of Account and Resale Restrictions: You agree and understand that the account you purchase is purchased either for yourself or on behalf of a client if you are an agent/union/guild/association. You understand that as an association, you are the individual solely responsible for all use of the account(s).
Content Policy:
All services provided by City-Demos may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any International law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless City-Demos from any claims resulting from the use of the service which damages the subscriber or any other party. Pornography and sex-related merchandising is prohibited on City-Demos. This includes sites that may infer sexual content, or links to adult content elsewhere. City-Demos will be the sole arbiter in determining violations of this provision. Also prohibited are sites that promote any illegal activity or present content that may be damaging to City-Demos or any other server on the internet. Links to such materials are also prohibited. Any illegal activity, including adult content, links to adult content web sites, spamming or hacking will result in your account being shut down and all your files deleted without warning. City-Demos will be the sole arbiter as to what constitutes a violation of this provision.
No Warranties:
City-Demos makes no warranties or representations of any kind for the services being offered. The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of title, non-infringement, or implied warranties of merchantability or fitness for a particular purpose. No advice or information given by City-Demos or its agents or employees shall create a warranty. City-Demos provides no warranty that the service will be uninterrupted or error free or that any information, software or other material accessible on the service is free from viruses or other harmful components. Under no circumstances shall City-Demos be liable for any direct, indirect, special, punitive, or consequential damages that result in any way from your use of or inability to use the service, or for third parties' use of the service to access your web space, reel, or to access the Internet or any part thereof, or your or any third parties' reliance on or use of information, services, or merchandise provided on or through the service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission, or any failure of performance. If you are dissatisfied with City-Demos' service or any of its terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the service. You understand that by placing information on City-Demos that such information becomes available to all Internet users and that City-Demos has no way of limiting or restricting access to such information or protecting such information from copyright infringement. You assume total responsibility and risk for your use of City-Demos and the Internet. It is solely your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services and other information, and the quality and merchantability of all merchandise provided through City-Demos. Your use of the service is at your sole risk. City-Demos is not responsible for files and data residing on your account You agree not to interfere with the operation of the system. You further agree not to interfere with the proper operation of other systems reachable through the Internet, including any attempt at unauthorized access. You agree to adhere to system policies as published by City-Demos, including restrictions on services available with each service type, restrictions on certain features, and all other policies. You agree to abide by any and all future City-Demos policy decisions. City-Demos reserves the right to monitor any and all communications through or with our facilities. You agree that City-Demos is not considered a "secure communications medium" for the purposes of the ECPA, and that no expectation of privacy is afforded.
User Conduct and Termination:
Our services may only be used for lawful purposes - any use of these services which violates any laws which may apply to City-Demos, your local jurisdiction, or any jurisdiction that you or your site may be subject to is strictly prohibited. This means that while using the service, you may not: Post or transmit any unlawful, threatening, abusive, defamatory, obscene, libelous, offensive, pornographic, indecent, profane, or otherwise objectionable information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any law. We reserve the right to refuse service to anyone for any reason not prohibited by law. Also, we reserve the right to terminate service to any customer for any reason not prohibited by law. Any deliberate attempt to cause damage to City-Demos will result in immediate account deactivation without prior notice. Such situations will be determined by City-Demos' sole discretion.
